LANCE T. LACKEY

Lance Lackey represents clients in commercial litigation, involving contract disputes, business torts, consumer class actions, product liability, real estate and property disputes, unfair competition, theft of trade secrets, copyright infringement, and false advertising. His practice also encompasses a wide variety of administrative and regulatory disputes. In 2004, 2006 and 2007, Lance was recognized by Law & Politics magazine as a “Rising Star” in the field of business litigation.

His experience includes jury and bench trials in both state and federal courts, as well as contested matters before the State Office of Administrative Hearings. Over the course of his career, Mr. Lackey has represented:

• One of the world’s largest specialty chemical companies in connection with a claim for theft of trade secrets against another chemical company
• One of the world’s largest mobile communications companies in national mass tort and consumer class action litigation
• An Internet-based market research firm against claims of false advertising and Lanham Act violations
• A communications software provider in a nationally publicized lawsuit involving claims for copyright infringement
• A foreign manufacturer of systems and equipment for the chemical and pharmaceutical industries in defense of a national class action involving personal injury, product liability and civil conspiracy claims
• A regional communications company in a dispute over a corporate acquisition
• One of the world’s largest telecommunications companies in the defense of a national consumer class action involving claims for breach of warranty and deceptive trade practices
• The nation’s largest office products retailer in administrative proceedings and a national class action involving “junk fax” claims under the Telephone Consumer Protection Act
• The world’s leading manufacturer, marketer, and distributer of soft drink beverages in an injunctive matter against its primary competitor

Prior to co-founding Lackey & Smith, PLLC, Mr. Lackey led the litigation practice of Barrett & Smith, PLLC, and was  Counsel at Akin Gump Strauss Hauer & Feld, LLP in Austin Texas. Previously, he was an associate at Brobeck, Phleger & Harrison, LLP in Austin, Texas and an associate at West, Webb, Allbritton & Gentry, PC in College Station, Texas.

Mr. Lackey received his B.A. in 1993 and his J.D. in 1997 from Baylor University, where he was a member of Phi Delta Phi and the Order of Barristers. While at Baylor, he received the John W. Joyce Moot Court Award; the Leighton B. Dawson Moot Court Award; and the Williams, Patillo & Squires Outstanding Oral Advocate Award.

Lance is a member of the State Bar of Texas and is admitted to practice before the U.S. District Courts for the Northern, Southern, Western and Eastern Districts of Texas and the U.S. Court of Appeals for the 5th Circuit. He is a Fellow of the Texas Bar Foundation and a member of the American and Austin Bar Associations. He is a former member of the American Inns of Court (Robert W. Calvert Inn) and the Pro Bono College of the State Bar of Texas.
