The focus of Lackey & Smith’s real estate practice is meeting our clients’ various real estate objectives and assisting them in every facet of their transactions. We consider ourselves “deal makers” while, at the same time, understanding and reducing the various risks our clients may face. The firm represents real estate owners, purchasers, brokers, landlords, tenants, and developers in all areas of their real estate business, focusing on personal relationships to assist our clients achieve their real estate goals. The firm has substantial experience with site acquisitions and sales; development and construction; leasing, ground leases, build-to-suit transactions; financings, equity, mezzanine, interim and permanent debt arrangements; and tax deferred exchanges, sale-leaseback programs and other dispositions of real property. The firm also represents clients in the formation and negotiation of organizational agreements between developers and equity sources, including partnerships, limited liability companies and other forms of development agreements.

Additionally, the firm utilizes its Land Use experience in dealing with a variety of governmental land use matters such as entitlements including zoning, subdivision and other land use issues, and development incentives for all our real estate clients. When combined with our Litigation practice, our attorneys have experience in real estate litigation, arbitration, mediation and dispute resolution involving real estate contract disputes, commercial landlord/tenant disputes, construction disputes, and other matters that cannot be resolved through negotiations.
